Palm Beach County is currently experiencing a wave of high-stakes real estate litigation, ranging from multi-million dollar construction disputes at major condominium developments to complex commission battles over residential property sales. These legal challenges highlight the growing friction between developers, contractors, and brokerages as they navigate contractual obligations in a competitive market.

The Nautilus 220 condominium complex in Lake Park has become the center of a significant legal standoff between its developer, Forest Development, and its builder, Kast Construction. The conflict escalated in July when both parties filed lawsuits against one another, citing breach of contract and failure to meet financial obligations.

Forest Development claims that Kast Construction failed to complete necessary work and provided inadequate supervision of subcontractors, leading to water damage and scheduling setbacks. Conversely, Kast Construction alleges that the developer failed to make over $11 million in progress payments and mismanaged design documents. The builder has since placed a significant lien on the project, further complicating the ability of the developer to finalize sales and provide clear titles to buyers.

Commission battle in Gulf Stream

In a separate legal matter, Palm Group Realty has initiated a civil lawsuit against a Gulf Stream homeowner and two competing brokerages. The dispute centers on a property at 920 Emerald Row, which was marketed as a pocket listing beginning in late 2025. The brokerage alleges that it is entitled to a 5 percent commission, asserting that it was the procuring cause of the sale.

The lawsuit claims that despite a signed compensation agreement, the homeowner later listed the property on the Multiple Listing Service with a different firm and entered into a purchase contract with the buyer originally introduced by Palm Group Realty. The case raises questions regarding the enforcement of buyer compensation agreements and the definition of procuring cause in private real estate transactions.
