Florida lawmakers are taking decisive action to enhance pool safety regulations for vacation rentals, spurred by a concerning rise in child drowning deaths. New legislation aims to implement stricter safety features at rental properties and expand water safety education for parents, particularly as the state anticipates an influx of visitors during spring break.

A significant piece of legislation, which has already passed the Florida Senate unanimously, requires vacation rental properties with a swimming pool or a body of water within 150 feet to install at least one approved safety feature. These features can include pool fences, pool safety covers, exit alarms on doors or windows leading to the pool area, or self-closing and self-latching doors.

This measure is particularly aimed at protecting visiting families who may not be fully aware of the risks associated with Florida’s numerous pools and waterfront properties. State Senator Carlos Guillermo Smith highlighted that tourists are often less familiar with these dangers.

The bill, a bipartisan effort co-sponsored by Senator Smith and Senator Danny Burgess, also allows for the suspension or revocation of vacation rental licenses for non-compliance. The support of organizations like Airbnb has been noted, with the company implementing its own in-app safety features and offering resources to hosts.

Addressing the Drowning Crisis

The legislative push is directly linked to a troubling increase in child drownings. In the previous year, Florida recorded a record 119 fatal child drownings, the highest number and rate in the nation. Senator Smith emphasized that these tragedies are preventable and that the proposed legislation offers concrete solutions.

Expanding Education and Prevention

Beyond rental property regulations, lawmakers are also focusing on education and prevention. One proposal seeks to expand the state’s swim lesson voucher program to cover children aged 1 to 7, up from the current age limit. Additionally, hospitals and birthing centers would be required to provide water safety education to new parents before they are discharged with their newborns. This initiative is crucial, as a significant percentage of fatal child drownings involve very young children.

Water safety advocates have welcomed these legislative steps, viewing them as vital in the ongoing effort to reduce drowning incidents in Florida, especially during warmer months when pool usage increases.
