Florida Realtors recently concluded a successful legislative session, advocating for policies that protect consumers and uphold industry standards. The organization achieved significant victories, including safeguarding the state’s real estate regulatory structure and strengthening laws against property squatting. Additionally, Florida Realtors updated essential forms to reflect current laws and industry best practices.

Key Takeaways

  • Florida Realtors successfully defended the state’s real estate regulatory structure and oversight, protecting consumers.
  • New laws were enacted to combat property squatting and protect private property rights.
  • Confusing septic system disclosure requirements at the point of sale were prevented.
  • Realtors were protected from liability regarding new property tax estimator disclosures.
  • Updated and new forms were released to align with MLS policy changes and current laws.

Legislative Victories and Consumer Protections

During the 2026 Legislative Session, Florida Realtors played a crucial role in shaping legislation beneficial to consumers and the real estate industry. A major win was the prevention of legislation that would have abolished the Florida Real Estate Commission and the Florida Real Estate Appraisal Board, thereby maintaining important consumer protections and the value of real estate licenses. Furthermore, the organization supported legislation that makes it a felony to occupy rental properties through fraudulent means, offering landlords a quicker way to remove such individuals.

Florida Realtors also successfully advocated for the removal of a confusing septic system disclosure requirement from a Department of Environmental Protection bill, allowing for more consumer-friendly alternatives to be developed. Additionally, they worked to protect Realtors from liability concerning new property tax estimator disclosures, ensuring buyers understand potential tax increases post-sale while shielding licensees from inaccurate information on online platforms.

Housing Program Support and Budget Allocations

Florida Realtors actively supported key housing initiatives during the budget special session. Proposals included significant funding for the Hometown Heroes Housing Program, with the House and Senate allocating $50 million and $75 million respectively. Funding was also directed towards the My Safe Florida Home and My Safe Florida Condo programs, with substantial amounts expected to be reverted from previous budgets. Both the State Housing Initiatives Partnership (SHIP) and State Apartment Incentive Loan (SAIL) programs were slated for full funding.

Industry Standards and Form Updates

In addition to legislative advocacy, Florida Realtors released new and updated forms effective January 5th. These revisions align with the National Association of Realtors’ MLS Policy on Multiple Listing Options for Sellers and incorporate current laws and local requirements. Notable updates include new combined compensation forms for sellers and buyers’ brokers, replacing older versions. Several listing, leasing, and buyer brokerage agreements were updated to reflect these policy changes and other legal adjustments, ensuring members have access to compliant and effective transaction documents.

Addressing Seller Concerns

Recent market analysis indicates that sellers are primarily concerned with pricing their homes correctly, planning for their next move, and maximizing their equity, rather than timing the market perfectly. Agents emphasize realistic pricing, leveraging accumulated equity, and utilizing modern marketing strategies. Concerns about market uncertainty and affording the next home are being addressed through strategies like sale contingencies, rent-back agreements, and buy-before-you-sell programs, offering flexibility and financial planning for homeowners navigating the current real estate landscape.
