Warren Presses Compass and MRED on Private Listings, Fair Housing and Competition Risks

Sen. Elizabeth Warren is seeking answers from Compass CEO Robert Reffkin and Midwest Real Estate Data CEO Rebecca Jensen about their partnership and private-listing network. Warren says the arrangement could reduce housing-market transparency, create unequal access to listings and data, and increase risks of housing discrimination and anticompetitive conduct.

Warren raises fair-housing concerns

In a nine-page letter, Warren argued that private, nonpublic listings could allow some consumers and real estate professionals to access inventory unavailable to others. She warned that unequal access may undermine fair competition and worsen existing inequalities in the housing market.

She also raised concerns that limited visibility into private transactions could facilitate residential steering, a practice prohibited under federal fair-housing law. If listings remain outside commonly monitored systems, patterns of potential discrimination could become more difficult for regulators and housing organizations to identify.

Questions about market transparency

Warren said private listings could obscure information buyers and sellers often use when negotiating, including how long a property has been listed and whether its price has changed. She suggested that withholding those details could affect pricing decisions and potentially destabilize the broader housing market.

The senator is asking the companies to explain the partnership’s structure, scope and expected effects, as well as whether they conducted reviews of possible antitrust and civil-rights implications.

Congressional scrutiny expands

The inquiry follows a separate review by the House Subcommittee on the Administrative State, Regulatory Reform and Antitrust. The panel began examining the Compass-MRED relationship and the possible effects of its private-listing network on buyers and sellers. Reffkin and Jensen were summoned to provide briefings by Aug. 5, according to the report.

The parallel investigations indicate that concerns about the arrangement extend beyond the Senate and could lead to closer examination of how private listing networks operate alongside established multiple listing services.

Advocacy groups seek federal review

In July, the Consumer Federation of America and housing, consumer and civil-rights organizations urged the Justice Department and Federal Trade Commission to investigate Compass’ recent deals. The groups argued that the arrangements could reduce transparency, strengthen an already dominant market position and limit equitable access to housing opportunities.

The inquiries do not establish that the partnership violated any law. However, they add pressure on Compass and MRED to explain how the network works and what safeguards are in place to protect competition, market transparency and fair access to housing.
