Warren Presses Compass and MRED Over Private Listings and Housing Access

Sen. Elizabeth Warren is seeking answers from Compass and Midwest Real Estate Data about a partnership that creates a private listing network. She warned that exclusive access to listings and market information could raise fair housing, antitrust and consumer-protection concerns, while making possible discrimination more difficult to identify.

Warren’s letter

In a nine-page letter, Warren, the ranking Democrat on the Senate Banking, Housing and Urban Affairs Committee, requested information about how the companies structured the partnership and whether they evaluated potential fair housing and antitrust risks.

She argued that a system in which some participants pay for exclusive access to listings and market data could disadvantage consumers who do not have access to the network. In her view, the arrangement could increase industry consolidation, restrict competition and contribute to higher housing costs.

Fair housing concerns

Warren said the private nature of the listings could make residential steering harder to detect. Steering occurs when housing professionals influence a buyer’s choices based on characteristics protected under federal and other civil rights laws.

The senator also warned that limiting visibility into private listings could make it more difficult to determine whether consumers are receiving equal access to housing opportunities. She asked the companies to explain what safeguards they have considered to prevent discriminatory outcomes.

Transparency and market data

The letter also focused on information commonly used by buyers, sellers and agents when evaluating a property. Warren said private listings may obscure details such as how long a home has been on the market and whether its price has changed.

According to the concerns outlined in the letter, reduced access to those data points could weaken consumers’ ability to negotiate and potentially affect the broader housing market. Warren asked the companies to describe how the partnership could influence pricing, competition and market stability.

Broader government scrutiny

The inquiry follows a review by the Subcommittee on the Administrative State, Regulatory Reform and Antitrust. The panel reportedly summoned Jensen and Reffkin to provide briefings by Aug. 5, after beginning its examination of the partnership and the private listing network in July.

Subcommittee Chair Scott Fitzgerald reportedly sent letters to the executives on July 22. The review adds congressional attention to questions about whether exclusive listing arrangements could affect competition and access to housing information.

Calls for federal investigations

The Consumer Federation of America and housing, consumer and civil rights organizations separately urged the Department of Justice and Federal Trade Commission to investigate Compass’ recent deals in early July.

The groups said the arrangements could reduce transparency, strengthen an already dominant market position and limit fair access to housing opportunities. Compass and MRED’s responses to the latest congressional questions will likely help determine how regulators and lawmakers assess the partnership.
